To approve the grant from the United States Secretary of Labor under the Workforce Investment Act (WIA) Title 1, National Emergency Grant (NEG) to the Federated States of Micronesia referenced in the amount of $2,350,000 for the purposes of providing temporary jobs for eligible dislocated workers and to assist in the cleaning and restoration activities in the State of Chuuk following the wake of Tropical Storm Chata'an.

Confirming the nomination of Mr. Marcus Samo to be the member representing Chuuk State on the Board of Directors of the National Government Employees' Health Insurance Program.

Extending the Second Special Session of the Thirteenth Congress of the Federated States of Micronesia for seven additional days.

Authorizing the Telecommunications Corporation of the Federated States of Micronesia [dba "Federated States of Micronesia Telecommunications Corporation"], pursuant to title 212, section 231(5), to incur debt and agree to liens or security interests in the assets of the Corporation.

Confirming the nomination of Mr. Carl Delfin Apis to serve as a member of the Board of Directors of the National Government Employees' Health Insurance Plan.

To approve a grant (Grant Cooperative Agreement #U90 CCU921821-01) to the Federated States of Micronesia from the United States Centers for Disease Control and Prevention ("CDC") for public health preparedness and response to bio-terrorism, in the amount of $488,522 for the first years $778,415 for the second year, and a separate $703,671 for hospital preparedness, with more funding to come at a later date.

To ratify the Agreement Between Solomon Islands, Australia, New Zealand, Fiji, Papua New Guinea, Samoa, and Tonga Concerning the Operations and Status of the Police and Armed Forces and Other Personnel Deployed to Solomon Islands to Assist the Restoration of Law and Order and Security was concluded and signed in Townsville.

To accede to the amendments to the Agreement Relating to the International Telecommunications Satellite Organization, and for other purposes.

To accede to the Convention for the Suppression of the Traffic in Persons and of the Exploitation of the Prostitution of Others, and for other purposes.

Approving the agreement for acceptance of financial assistance from the Government of the United States of America for the first month of fiscal year 2004.

Congratulating His Holiness, Pope John Paul II, on the twenty-fifth anniversary of his reign as pontiff of the Roman Catholic Church.

Approving the Agreement for Domestic Based Foreign Fishing Vessels between the National Oceanic Resource Management Authority and National Fisheries Corporation.

Approving the Foreign Fishing Agreement between the National Oceanic Resource Management Authority and Korea Deep Sea Fisheries Association.

Approving the Agreement for Domestic Based Foreign Fishing Vessels between the National Oceanic Resource Management Authority and Pacific Foods and Services Incorporated.

Expressing the FSM Congress’ profound disagreement with the FSM President’s and Vice President’s hasty decision(s) during the October, 2003, Economic Policy Implementation Conference (EPIC) in agreeing with the FSM states to reduce the FSM Government’s revenue share under the Amended Compact, which decision(s) will place the National Government’s well being in serious jeopardy.

Approving the application to the United States Department of Interior for a $55,000 technical assistance grant to fund the Auditor Training program during 2004 and 2005.

Approving certain agreements for acceptance of financial assistance from the Government of the United States of America for fiscal year 2004.

Approving the proposal to the United States Department of Interior for a $[130,000] 100,000 technical assistance grant to supplement the funding for the Third National Economic Summit.

Disapproving the continued service of retired FSM Supreme Court Justice Richard H. Benson, whose cumulative service as a temporary Justice has exceeded three months.

Confirming the nomination of Mr. Lorin S. Robert to serve as a member of the National Oceanic Resource Management Authority.

Confirming the nomination of Mr. Nena S. Nena to serve as a member of the National Oceanic Resource Management Authority.

Respectfully requesting the Thirteenth Congress of the Federated States of Micronesia to hold a congressional session in the State of Yap.

Requesting that the President direct the Secretary of the Department of Justice to investigate the facts and circumstances surrounding the purchase of real property in Chuuk State by the College of Micronesia-FSM.

Congratulating Mr. Manuel Miningfel of Yap for being the number one weightlifter in all weight divisions in the entire Pacific and being the first FSM athlete to ever qualify for an Olympic Games and rank in top ten on the Olympic Qualification Ranking List in his weight category (62kg).

Expressing the appreciation of the citizens and the Congress of the Federated States of Micronesia to the athletes, coaches and support staff representing the Federated States of Micronesia in the 2004 Olympic Games.

Expressing the sincere appreciation and heartfelt gratitude of the Thirteenth Congress of the Federated States of Micronesia to all the governments, corporations, businesses, foundations, the U.S. Federal Emergency Management Agency, U.S. Coast Guard, the Government and People of Guam, the Ayuda Foundation, Sky Blue Air, citizens of Yap residing in Guam, and various individuals for their swift outreach, response and urgently needed assistance which included monetary donations, food, clothing, water and medicine for the State of Yap during the aftermath of Typhoon Sudal.

Requesting and encouraging the Chief Executives of the Governments of the Pacific Island states to enter into a Free Trade Agreement among Association of Pacific Island Legislatures (APIL) member entities and with the United States Government at the earliest possible opportunity, in order to support the recovery of the ailing economies of Pacific Island states.

Approving the acceptance of technical and financial assistance from the Government of the United States of America.

Requesting the National Oceanic Resource Management Authority to mandate that fishing vessels licensed to fish in the FSM fishery waters off-load their catch in FSM ports.

Requesting the Federal Transportation Safety Administration to eliminate the current requirements that passengers in-transit exit the plane at every island stop, when the passenger will be traveling on the same aircraft to their final destination. 

Requesting the Executive Branch of the Federated States of Micronesia to develop a Strategic Plan for the Prevention of Tobacco, Alcohol and Substance Abuse in this nation.

Confirming the nomination of Ms. Jane J. Chigiyal to be the National Government representative on the Board of Directors of the FSM Telecommunications Corporation.

Calling upon the President of the Federated States of Micronesia to request the assistance of the Government of the United States in studying the effects of the United States Nuclear Testing Program on the territory and populations of the Federated States of Micronesia, and in securing just compensation for victims of radiation exposure as a consequence of activities related to the U.S. Government's nuclear tests in Micronesia.

Approving the Foreign Fishing Agreement between the National Oceanic Resource Management Authority and Korea Deep Sea Fisheries Association.

Approving the Agreement for Domestic Based Foreign Fishing Vessels between the National Oceanic Resource Management Authority and National Fisheries Corporation.

Approving the Agreement for Domestic Based Foreign Fishing Vessels between the National Oceanic Resource Management Authority and Pacific Foods and Services Incorporated.

Respectfully requesting the government of the United States of America to ease some of its immigration restrictions on the citizens of island members of the Association of Pacific Island Legislatures (APIL) when entering Guam, CNMI, Hawaii, and the U.S. mainland.

Urging the President to appoint an honorary counsel to represent the interests of the Federated States of Micronesia in Europe.

Expressing the sadness and condolences of the Thirteenth Congress of the Federated States of Micronesia at the sudden passing of Senator Reed G. Nena of Kosrae State.

Requesting the National Oceanic Resource Management Authority to impose a two-year moratorium on the entry into and renewal of fishing agreements with respect to the fishery waters of the Federated States of Micronesia.

Expressing the sincere appreciation of the Thirteenth Congress of the Federated States of Micronesia to the Government of the Russian Federation for its Ratification of the Kyoto Protocol to the United Nations Framework Convention on Climate Change.

Expressing and extending the sympathy and condolences of the people and the Congress of the Federated States of Micronesia to the Prime Minister of Japan and the people of Japan at this time of their tragedy and loss resulting from the Saturday, October 23, 2004 earthquake, and typhoon Tokage.

Expressing concern that the government of the United States of America, by imposing unnecessarily onerous and restrictive conditions on its operational and sector grants to the Federated States of Micronesia, is acting contrary to the spirit of the Compact of Free Association, as amended.

Confirming the nomination of Mr. Matthew Phelan to serve as the Secretary of the Department of Justice.

Expressing sincere congratulations to the Honorable Koisimy Hadley, the Nanmwarki of Madolenihmw upon his elevation to the traditional titleship of "Wasa Lapalap Isipahu", Nahnmwarki of Madolenihmw Municipality in the State of Pohnpei, FSM.

Expressing the sincere appreciation of the Government of the Federated States of Micronesia to the former Regional Maritime Legal Advisor for the Regional Maritime Programme of the Secretariat of the Pacific Community, Captain Dr. Peter Heathcote, for his assistance and support in the promulgation of various FSM Maritime Regulations and the drafting of the National Maritime Act of 1997.

Authorizing the President of the Federated States of Micronesia to submit the Proposed FSM Strategic Development Plan to the Joint Economic Management Committee, on a provisional basis, pending review and approval by Congress.

Shortening the Sixth Special Session of the Thirteenth Congress of the Federated States of Micronesia.

Expressing the profound appreciation of the Congress of the Federated States of Micronesia to the Government, traditional leaders and people of the State of Yap for hosting the Sixth Special Session of the Congress of the Federated States of Micronesia.

Setting the ceiling of the total funds estimated to be available for appropriation from the General Fund of the Federated States of Micronesia for the fiscal year ending September 30, 2005.

Approving the application for Technical and Financial Assistance requested under the United States Department of Interior, Office of Insular Affairs for the purpose of funding the new Uniform Financial Management Information System for all five FSM Governments.

Approving Airport Improvement Program project grant agreements between the Federated States of Micronesia and the United States.

Urging the President of the Federated States of Micronesia and the National Oceanic Resource Management Authority to ban all fishing by the Sanko Bussan Co., Ltd. in the [Extended Fishery Zone] Exclusive Economic Zone of the Federated States of Micronesia by denying it the ability to obtain any future fishing licenses to fish the [Extended Fishery Zone] Exclusive Economic Zone of the Federated States of Micronesia unless and until action is taken to satisfy a judgment in favor of the People of Satawal.

Authorizing the Chairman of the Ways and Means Committee, on behalf of and in the name of Congress, to initiate a lawsuit, in the national courts, seeking a declaration as to the respective powers of the Executive Branch and the Legislative Branch with respect to the establishment of a method for dividing Compact monies with the states.

Expressing the heartfelt condolences of the Thirteenth Congress of the Federated States of Micronesia to the victims of the December 26, 2004, earthquake and tsunami.

Setting the ceiling of the total funds estimated to be available for appropriation from the General Fund of the Federated States of Micronesia for the fiscal year ending September 30, 2005.

To shorten the Fifth Regular Session of the Thirteenth Congress of the Federated States of Micronesia.

Approving Australian Government funding for a project to promote the establishment of complementary national and state juvenile justice programs.

Adopting the Federated States of Micronesia National Drug Policy.

Confirming the nomination of Mr. Valerio Hallens to be the National Government representative on the Board of Directors of the FSM Telecommunications Corporation.

Expressing concern regarding the actions of the United States of America in relation to the accident involving the nuclear submarine USS San Francisco on January 8, 2005.
